The U.S. Department of Ed has released clarifying information on the rights of students with ADHD. (Attention-deficit/hyperactivity disorder)

The guidance was based around Section 504 of the Rehabilitation Act of 1763. It specifically covered the obligations of the school to ensure compliance with the existing laws based around students with ADHD.

 Some of the clarifications include guidance around:

• Evaluation of students believed to need services
•  Obligation around providing need-based services
•  Providing parents/guardians with due process and chances to appeal identification decisions

Around 10 percent of the disability discrimination claims received by the Office of Civil Rights over the last five years were around ADHD.

The hope is that this guidance will reduce that number.
